RE: The tariff classification of conveyors from Spain

Dear Mr. Ruane:

In your letter dated May 21, 2013, you requested a tariff classification ruling on behalf of your client, Vertique of Arden, North Carolina.

The items under consideration have been identified as five (5) types of conveyors. They include a Buffer Conveyor, a Chain Conveyor, a Roller Conveyor, a Transfer Conveyor and a Turn Roller Conveyor. The Buffer Conveyor is a two strand chain conveyor positioned between the loading position of the aisle shuttles and the pallet lifts. It accepts a pallet and holds the pallet for transfer. The Chain Conveyor is used to transport and buffer pallets flowing into and out of the system. The Roller Conveyor is used for the transport of pallets with loads of up to a maximum weight of 1500 kilograms. The Transfer Conveyor is used at the change of direction points in the pallet handling system. The Turn Roller Conveyor is used within the pallet material handling system when pallet direction changes are required.

The applicable subheading for the conveyors of will be 8428.39.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other lifting, handling, loading or unloading machinery … : Other continuous –action elevators and conveyors, for goods and materials: Other”. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
