RE: The tariff classification of a lifting and handling machine from Switzerland

Dear Ms. Song,

In your letter dated April 10, 2013, you requested a tariff classification ruling on behalf of Jier North America, Inc. of Plymouth, Michigan.

The item being considered has been identified as an RBS Robobeam Stand Alone System. You state in your request that the system will be imported unassembled, and will be assembled at its final destination. It is designed for the transfer of large steel and aluminum sheets in tandem lines with a distance between the presses of up to 8500 millimeters (mm). The suction beams, which are designed to load and unload unattached or attached blanks from the press and to the press, are guided on both sides to assure high stability, especially for large surface sheets. The system, which has its own motor, is based on a solid structured linear guidance rail that has been optimally designed for high dynamic loads. Due to the innovative and highly dynamic control technology, it allows the motion to be continuously operated without stopping. The individual transfer units are synchronized, always following the corresponding presses crank angle. Presses are not included with the RBS Robobeam Stand Alone System.

The applicable classification subheading for the RBS Robobeam Stand Alone System will be 8428.90.0290, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other lifting, handling, loading or unloading machinery … : Other machinery: Other”. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
