RE: The tariff classification of a picnic blanket from China*

Dear Ms. Hattersley:

In your letter dated Jan. 15, 2013, you requested a tariff classification ruling. We requested a sample and in an undated response received in our office on Mar. 5, 2013, you supplied it. The sample will be returned.

The submitted sample is called Foldable Lawn Blanket (Stock #BH21-009-299-01). While you call it a blanket, please note that because it is filled it cannot be considered a bedding-type blanket for tariff purposes. Explanatory Note 63.01 noted. In addition, its intended use is not as an article of bedding: you state that it “is marketed as a lawn blanket for the use of outdoors, either picnic, sporting events, and for use on the lawn to relax. When it is zipped up and folded, it can also be used as a seat cushion at a sporting event.”

The picnic blanket measures 60” x 70”. It consists of two layers of woven polyester fabric with a polyester filling. The top surface is woven of fine yarns and is a “pretty plaid pattern for a summery look.” The bottom surface is woven of coarser textured yarns for added protection from the ground.

The blanket can be folded and zipped up for easy carrying and storage, with a handle and pocket. It folds to 19” x 14” with a 12” x 10” pocket.

The applicable subheading for the Foldable Lawn Blanket (Stock #BH21-009-299-01) will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
