RE: The tariff classification of “Metrop Root Plus” and “Metrop Bloom Plus” from The Netherlands
Dear Mr. Miminhia:
In your ruling request dated March 1, 2013, you requested a tariff classification ruling.
Your letter indicates that the two products at issue are chemical-based liquid fertilizers. “Metrop Root Plus” and “Metrop Bloom Plus” will be packaged for retail sale in 250 milliliter, one liter, and five liter plastic containers. The provided packaging label for “Metrop Root Plus” indicates that this is a high-quality fertilizer containing nitrogen and phosphoric acid necessary for the growth of roots in any medium. The provided packaging label for “Metrop Bloom Plus” indicates that this is a high-quality plant fertilizer containing nitrogen and phosphoric acid for the growth of bloom in any medium.
The applicable subheading for both, “Metrop Root Plus” and “Metrop Bloom Plus” will be 3105.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Mineral or chemical fertilizers containing two or three of the fertilizing elements nitrogen, phosphorus and potassium; other fertilizers; goods of this chapter in tablets or similar forms or in packages of a gross weight not exceeding 10 kg: Products of this chapter in tablets or similar forms or in packages of a gross weight not exceeding 10 kg. The general rate of duty will be free.
