RE: The tariff classification of a pendant watch and chain

Dear Mrs. Glover:

In your letter dated November 19, 2012 you requested a tariff classification ruling on behalf of Avon Products, Inc. A sample was furnished with your request and is being returned as requested.

Item number PP 5030144 is a heart pendant watch necklace. The pendant watch has a heart-shaped alloy watch case with cover. The watch case and cover are made of brass, which is plated with copper, white bronze and PCP. The dial of the watch is made of faux mother of pearl and the watch lens is a flat lens and is made of glass. The watch is battery operated and contains a quartz movement with no jewels.

The chain necklace is made of brass which is plated with copper, white bronze and PCP. The chain is 24 inches long with a 3.5 inch extension chain. The pendant watch is not permanently affixed to the chain necklace.

The applicable subheading for the pendant watch will be 9102.91.40, Harmonized Tariff Schedule of the United States (HTSUS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101: other: electrically operated: other: having no jewels or only one jewel in the movement. The rate of duty will be 40 cents each plus 6 percent on the case plus 5.3 percent on the battery.

The applicable subheading for the chain will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for imitation jewelry; of base metal, whether or not plated with precious metal, other; other; other. The rate of duty will be 11 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
