RE: The tariff classification of a children’s jean jacket from India.
Dear Mr. Nelson:
In your letter dated November 6, 2012, you requested a tariff classification ruling. As requested, the sample will be returned to you.
Your submitted sample, Style GL254453 is a girl’s (size M) jean jacket constructed from 70% cotton, 30% Elasterell polyester woven denim fabric. The jacket has a full front opening with a five button, right over left closure, long sleeves with a buttoned cuff, venting at the wrist, a back yoke, a banded bottom with waist tabs, a pointed collar and set-in chest pockets with flap closures secured by metal snaps. The jacket will be imported in girl’s sizes XS (5/6), S (7/8), M (10/12), L (14) and XL (16). The jacket will also be imported in infant sizes 12, 18 and 24 months.
The applicable subheading for Style GL254453 (girl’s sizes) will be 6202.92.2071, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles (including padded, sleeveless jackets), other than those of heading 6204: anoraks (including ski-jackets), windbreakers and similar articles (including padded sleeveless jackets): of cotton: other, other: girls’. The rate of duty will be 8.9 percent ad valorem.
The applicable subheading for Style GL254453 ( infant’s sizes) will be 6209.20.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories: of cotton: other, other: other. The rate of duty will be 9.3 percent ad valorem.
