RE: The tariff classification of watch boxes from China

Dear Mr. Wells:

In your letter dated October 31, 2012, you request a tariff classification ruling. Your samples will be returned to you.

Styles 997698 and 997719 are hinged watch boxes constructed with a molded plastic base. Both styles are wholly covered on the exterior surface with paper. The paper is the outer surface constituent material. They are specially shaped and fitted to contain one watch. Each box has a center compartment with a removable textile-covered pillow. They are designed to provide storage, protection, and organization to one watch subsequent to its initial use. The boxes are suitable for long-term use. They each measure approximately 4.5" (W) x 4.5" (D) x 2.5" (H).

The applicable subheading for styles 997698 and 997719 will be 4202.99.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, of materials (other than leather, composition leather, sheeting of plastic, textile materials, vulcanized fiber or paperboard) wholly or mainly covered with paper. The rate of duty will be 3.4 percent.

Your inquiry does not provide enough information for us to give a classification ruling on styles 997685, 998623, and 998194. Your request for a classification ruling and your subsequent information is not consistent with our examination of the samples. If these samples are not of the precise construction of the samples that will be imported, please provide samples in the condition that they will be imported into the United States. Please clarify the construction of each sample. For each sample, state the base material. Provide the material on the outermost surface of each box. Provide the chemical breakdown of all plastics used in any of the samples. Provide the fiber content of any textile material used in the construction of the boxes.

When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
