RE: The tariff classification of two pendent watches from China
Dear Ms. Lewis:
In your letter dated October 2, 2012 you requested a tariff classification ruling. Samples of the two pendent watches were submitted with your ruling request.
The bracelet wrist watch is a gold-plated base metal pendent watch that is permanently affixed by a jump ring to a gold-plated base metal chain bracelet. There is a floral enamel motif framing the watch face. The bracelet secures with a toggle clasp. The watch is a battery operated analog watch with a quartz movement with no jewels.
The necklace watch is a gold-plated pendent watch that is permanently affixed by a jump ring to a base metal chain measuring approximately 31.75 inches. There is a floral enamel design framing the watch face. The necklace chain secures with a toggle clasp. The watch is a battery operated analog watch with a quartz movement with no jewels.
The applicable subheading for the bracelet wrist watch will be 9102.11.10, Harmonized Tariff Schedule of the United States (HTSUS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101: wrist watches, electrically operated, whether or not incorporating a stop watch facility: with mechanical display only: having no jewels or only one jewel in the movement: with strap, band or bracelet of textile material or of base metal, whether or not gold- or silver-plated: with gold- or silver-plated case. The rate of duty will be 44 cents each plus 6 percent ad valorem on the case plus 14 percent ad valorem on the strap, band or bracelet plus 5.3 percent ad valorem on the battery.
The applicable subheading for the necklace watch will be 9102.91.40, Harmonized Tariff Schedule of the United States (HTSUS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101: other: electrically operated: other: having no jewels or only one jewel in the movement. The rate of duty will be 40 cents each plus 6 percent ad valorem on the case plus 5.3 percent ad valorem on the battery.
