RE: The tariff classification of an ePure cordless analog telephone from China
Dear Mr. Harris:
In your letter dated October 2, 2012, you requested a tariff classification ruling on behalf of your client, Swissvoice Inc.
The merchandise subject to this ruling is an ePure Cordless analogue telephone (DECT). It is a neo-retro, cordless telephone equipped with a 3.7 V, 550 mAh lithium-ion battery with up to ten hours of talk time, and 150 hours in stand-by time. It has an outdoor range of 300 meters and indoor up to 50 meters. The phone comes in black, white or red. It has a wireless handset with hands free option and a wireless base. The handset has a low radiation mode, and a ¼ inch backlit dot matrix display. The base has an alarm function, volume control for ringer and loudspeaker, ten ringer melodies, keypad lock, mute feature, clock, pager for handset, call transfer and conference call feature.
The ePure Cordless analogue telephone (DECT) is equipped with a directory for one hundred entries, caller number and name indication, redials, call duration time and dial preparation before dialing. It is expandable up to five handsets and four bases, and it has low energy consumption power adaptor.
The applicable subheading for the ePure Cordless analogue telephone (DECT) will be 8517.11.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical apparatus for line telephony or line telegraphy, including line telephone sets with cordless handsets and telecommunication apparatus for carrier-current line systems or digital line systems… Telephone sets: videophones: Line telephone sets with cordless handsets.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
