RE: The tariff classification of a headlamp conversion kit from China

Dear Mr. Liu,

In your letter dated August 28, 2012, you requested a tariff classification ruling on behalf of AFC Trident, Inc. of Chino, California.

The item being considered is the “HID High Intensity Discharge Lamp System”. You state that this item is used as automobile headlights. It consists of the following parts - two (2) light bulbs with wire attachments and two (2) ballasts with a wire harness and the brackets and attachment bolts. The light bulbs are filled with xenon. The ballast, when activated, will generate voltage up to 23,000 volts; the xenon will then produce an electric arc which will emit light from 4,300 Kilowatts to 10,000 Kilowatts between two (2) electrodes.

The applicable classification subheading for the “HID High Intensity Discharge Lamp System” will be 8512.20.2040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical lighting … equipment … of a kind used for … motor vehicles … : Other lighting … equipment: Lighting equipment: For … vehicles … .” The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
