RE: The tariff classification of flat panel display monitors from China
Dear Mr. Middleton:
In your letter dated August 28, 2012, on behalf of your client, NEC Display Solutions of America, Inc., you requested a tariff classification ruling.
The subject merchandise, based on the submitted information, consists of large-screen LCD color monitors, MultiSync V462 and V551, with diagonal-screen sizes measuring approximately 46 inches and 55 inches, respectively. These monitors, with full 1080p high-definition resolution, have built-in, low-profile 10W speakers and a built-in expansion slot for seamless integration of NEC accessories, third-party components, and open pluggable specification (OPS)-based products.
It is noted that these monitors, which are designed for use as signage in various venues, e.g., restaurants and conference rooms, are capable of accepting signals from ADP machines, i.e., Apple Macintosh computer systems and PC’s, in a form that meets the requirements of the user. Furthermore, they can display clear video images from different sources, such as a DVD player with HDMI output, but they do not contain any inbuilt video recording or reproducing apparatus, or a television tuner.
The applicable subheading for this merchandise, being imported without a tuner, will be 8528.59.3100, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatus…Other monitors: Other: Color: With a flat panel screen: Other: Other: Flat panel display devices designed for use with an automatic data processing machine, as defined in additional U.S. note 13 to chapter 85. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
