RE: The tariff classification of laminating pouches
Dear Mr. Hoffman:
In your letter dated July 10, 2012, on behalf of Amax, Inc., you requested a tariff classification ruling.
You have provided information on hot and cold laminating pouches. The laminating pouches are pockets sealed on one side into which items to be laminated are inserted. The hot laminating pouches are composed of polyester film with an adhesive resin. When pouches are inserted into the hot laminator, the heat activated adhesive resin layer spreads over the document, hardening as it cools and creating a bond between the paper and the pouch. The cold laminating pouches are composed of polyester film with an adhesive that is activated by pressure. The cold laminating pouches may be used to laminate heat sensitive items such as faxes, photos, and ink-jet printer paper without damaging them. The adhesive is between the two layers of the pouch and not on either surface of the pouch exterior.
You did not specify the country of origin. The rate provided below is the rate applicable to the merchandise when it is manufactured in a country with which the United States has Normal Trade Relations.
The applicable subheading for the hot or cold laminating pouches will be 3926.90.9980, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem.
