RE: The tariff classification of a printed tea light candle holder from China

Dear Ms. Schab:

In your letter dated July 2, 2012, you requested a tariff classification ruling.

The ruling was requested on a glass tea light candle holder, item #11577. The tea light candle holder consists of two square shaped, glass panels with beveled edges and a glass receptacle attached to a small glass shelf between the two parallel glass panels. The receptacle is specifically sized to hold a tea light candle. The translucent glass panels measure approximately 4.72 inches x 4.72 inches and sit 2.50 inches apart. The circular glass holder measures approximately 2 inches in diameter and 1 inch in height. The tea light candle holder is affixed between the two panels. The glass panels are coated with black and gray stripes and have a printed section, which is clear and is located in the center of the glass square and reads, “LIVE, LAUGH, LOVE”. The candle holder will illuminate the printed sentiment when a tea light candle is placed in the holder and lit. The top, sides and bottom of the candle holder are open. You state in your letter that the tea light candle holder is available in two designs. The essential character of the candle holder is imparted by the printed sentiment. The LIVE, LAUGH, LOVE candle holder is designed to be placed on any flat surface.

The sample submitted will be returned to you as requested.

The applicable subheading for the tea light candle holder will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other printed matter, including printed pictures and photographs: Other: Other: Other: Other. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
