RE: The tariff classification of Christmas Stocking Holders from China

Dear Mr. Cullen:

In your letter dated May 14, 2012, on behalf of CVS Caremark, you requested a tariff classification ruling.

You submitted samples of two styles of Christmas Stocking Holders, identified as item number 890595. Both styles are constructed of 58% Polyresin and 42% Stone Powder. Each measures approximately 5 inches high x 4 inches wide with a hook protruding at the base from which a Christmas stocking can be hung.

The first style portrays two snowmen wearing coats, scarves and red and white Santa hats. The larger snowman is holding a decorated gift box. There is an additional decorated gift box and holy leaves and berries on the base.

The second style portrays two bears wearing coats, scarves and red and white Santa hats. The lager bear is holding a decorated Christmas tree and has holy leaves and berries on his hat. The smaller bear is holding a jack-in-the-box with a snowman wearing a Santa hat popping out. There is a candy cane and holy leaves and berries on the base.

The samples will be returned per your request.

The applicable subheading for item number 890595 will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
