RE: The tariff classification of a bulletproof carrier and ballistic panel from Vietnam.

Dear Mr. Vilay

In your letter dated February 16, 2012, you requested a tariff classification ruling. The samples will be returned to you as requested.

The submitted sample, Style 32V500-04-CTS, is a bulletproof carrier composed of nylon fabric. The unisex garment resembles a vest and provides no ballistic protection without the steel plates. It is a carrier for the steel insert that provides ballistic protection. The garment consists of two pieces, front and back, which are attached to each other with straps and hook and loop closures.

The applicable subheading for the bulletproof carrier will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of man-made fibers, Other.” The rate of duty will be 16% ad valorem.

You also requested the classification of ballistic armor panels and a bulletproof carrier with armor panels under Schedule B.

The submitted sample, Style C32SP13-MD-ST34A, is a ballistic armor panel. It is constructed of an outer shell of woven nylon fabric that is coated with polyurethane; the outer shell surrounds inner layers of woven Kevlar fabric.

For export purposes, the ballistic armor panels are classifiable under Schedule B number 6217.90.9085; the bulletproof carrier with armor panels are classifiable under Schedule B number 6211.43.0091.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
