RE: The tariff classification of Flameless Ration Heater (FRH) from China

Dear Ms. Sutera:

In your letter dated September 7, 2011 you requested a tariff classification ruling on behalf of your client AmeriQual Group. The actual sample of the Flameless Ration Heater was not submitted with your ruling request. A similar item and descriptive literature were submitted for review.

The Flameless Ration Heater (FRH) is a disposable, water activated, chemical heater sleeve. The item is designed for use to heat an individual eight ounce, Meal Ready to Eat (MRE), field ration. The heater sleeve contains finely powdered iron, and magnesium metals. Also included is a pouch containing salt water. The water is poured into the heater sleeve creating a chemical reaction, thereby generating steam heat. The disposable ration heater is designed to heat an eight ounce meal in 10-12 minutes. The sample will not be returned.

The applicable subheading for the Flameless Ration Heater (FRH) will be 3824.90.3900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Prepared binders for foundry molds or cores; chemical products and preparations of the chemical or allied industries (including those consisting of mixtures of natural products), not elsewhere specified or included: Other: Other: Mixtures of two or more inorganic compounds: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
