RE: The tariff classification of plastic storage organizers from China
Dear Ms. O’Shea-Moran:
In your letter dated August 9, 2011, on behalf of Lamrite West Inc you requested a tariff classification ruling.
The three submitted samples are all made of clear molded plastic and are designed to be used for organizing and storing crafts or other household items. As you requested, the samples will be returned to you. They are identified as follows:
Item 10767 – Deluxe Organizer measures approximately 10¾” x 7½” x 1¾” and features eight storage compartments, a built-in handle, and a lid that is attached by hinges on one side and snaps closed on the other side.
Item 2001-50 – Plastic Storage Containers consists of four removable identical storage containers that are fitted into a travel carrier which features a carry strap. Each container is removable from the carrier and measures approximately 4¾” x 3¼” x 1”. Each container has 6 compartments of varying dimensions and a lid that is attached by a hinge on one side and snaps closed on the other side. When the four containers are situated in the carrier, two on each side, the entire item measures approximately 7¼” x 5” x 2¼”, not including the carry strap.
Item 2025-286 Stackable Organizer consists of three stackable containers, two that are identical and one that is larger than the other two. Each container has one large internal compartment. Each of the two identical containers measures approximately 8½” x 5¾” x 1¼” in height and the third container measures approximately 8½” x 5¾” x 2¼” in height. All three containers snap together for the purpose of stacking and can be stacked in any order. The item includes a lid with a carry handle that can be snapped onto which ever container is stacked on top. The entire item, when stacked, measures approximately 8½” x 5¾” x 5½” in height, not including the carry handle.
The applicable subheading for Item 10767, Item 2001-50 and Item 2025-286 will be 3924.90.5650, Harmonized Tariff Schedule of the United States (HTSUS), which provides for …other household articles…of plastics: other: other…other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
