RE: The tariff classification of clothing accessories from China.
Dear Mr. LoPresti:
In your letter dated July 21, 2011, on behalf of Elie Tahari LTD, you requested a tariff classification ruling. The samples will be returned to you.
Style A80JG501 is a ladies neck accessory constructed of woven 100% cotton fabric. The item is a floral, heavy cut out design that measures approximately 17 inches in length and 8 inches in width at the top. The article snaps around the neck and is tied around the waist.
Style A8184501 is a ladies neck accessory constructed of woven 100% silk fabric. The item is trimmed with leather and is a heavy design. The article is worn by placing an arm through an opening on each side and tying it around the back and waist. The accessory measures approximately 9 inches across the chest and 11 inches in length.
Each item can be worn with various clothing.
The applicable subheading for Style A80JG501 will be 6217.10.9510, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories; parts of garments or of clothing accessories…Accessories: Other: Other, Of cotton." The duty rate will be 14.6 percent ad valorem.Â
The applicable subheading for Style A8184501 will be 6217.10.1090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories, other than those of heading 6212: Accessories: Containing 70 percent or more by weight of silk or silk waste, Other." The duty rate will be 2.3 percent ad valorem.
