RE: The tariff classification of an egg timer from China

Dear Ms. Pendris:

In your letter dated June 29, 2011 you requested a tariff classification ruling. A sample was furnished to this office with your letter and will be returned as requested.

The article is referred to as an egg timer, item number 69820. The 60 minute timer is composed of polypropylene and is in the shape of a fried egg. The timer can be set for one minute up to 60 minutes and rings for three seconds when the timing is complete. It is a wind up timer and requires no batteries. It measures approximately 4 ¾ inches wide by 2 inches high.

The applicable subheading for the egg timer, item number 69820, will be 9106.90.85, Harmonized Tariff Schedule of the United States (HTSUS), which provides for timers. The rate of duty will be 15 cents each plus 2.3 percent plus 0.8 cents per jewel.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
