RE: The tariff classification of a string light set with a rectifier adaptor from China.
Dear Ms. Purcell:
In your letter dated June 21, 2011, you requested a tariff classification ruling.
The item under consideration is identified as a Plug Adaptor with Strands Light Set, item number Adap-001. A sample was submitted with your ruling request and will be returned to you.
The Plug Adaptor with Strands Light Set is a string light set and a rectifier adaptor. It consists of three twisted green insulated 22 AWG (American wire gauge) conductors measuring approximately 16 feet long with 50 miniature lights evenly spaced along the light string. Each miniature light contains 2 LEDs (light emitting diodes), one white and one of color (red, green and blue), wired together utilizing reverse parallel LED Technology. At one end of the light string is a 9 inch wire lead with a two-prong receptacle; at the other is a 19 inch wire lead with a combination two-prong plug/socket with a built-in fuse rated for 3 amps (A) and 125 volts (V). The light string illuminates all white lights when connected to power without the rectifier adaptor. The Wave Rectifier Adaptor includes the rectifier circuitry that controls the polarity of the current moving through the light string, which transforms the light string into a multi-color light string. The light string and adaptor will be imported packaged together ready for retail sale. The Plug Adaptor with Strands Light Set will be advertised and displayed on a Christmas tree, wreath or garland.
The applicable subheading for the Plug Adaptor with Strands Light Set, item number Adap-001will be 9405.30.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings…: Lighting sets of a kind used for Christmas trees…: Miniature series wired sets.” The general rate of duty will be 8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
