RE: The tariff classification of aluminum walkboards from China
Dear Ms. Huffman:
In your letter dated June 6, 2011 you requested a tariff classification ruling on behalf of your client Grady F. Smith and Co. Inc., DBA Urenco Equipment Rentals.
The products to be imported are stated to be described as aluminum scaffold parts or aluminum planks on the shippers commercial invoice. Pictures submitted, as well as additional information from the importer, indicate that the products are known, more specifically, as aluminum scaffolding walkboards, and are fully assembled units in their imported condition. The components of the walkboards are manufactured by the extrusion process from 6061 T6 aluminum alloy. Five different aluminum extrusions are further processed by indenting for treads, drilling, punching, notching, and chamfering. The main five parts or beams are then assembled with other parts and fasteners into a single piece identifiable and usable as a walkboard. The walkboard is stated to be imported fully assembled and ready to use. The product will not be further processed in the U. S. after importation. It is described as a stand alone product which is sold to customers for use in scaffolding projects. It appears to this office from pictures and descriptions to be a finished product, namely a scaffold walkboard, containing aluminum extrusions as parts that are fully and permanently assembled and complete at time of importation.
The applicable subheading for the aluminum walkboard will be 7610.90.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for aluminum structures (excluding prefabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge sections, lock gates, towers, lattice masts, roofs, roofing frameworks, doors and windows and their frames and thresholds for doors, shutters, balustrades, pillars and columns); aluminum plates, rods, angles, shapes, sections, tubes and the like, prepared for use in structures, other, other, other. The rate of duty will be 5.7 percent.
The merchandise in question may be subject to antidumping duties or countervailing duties. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs and Border Protection. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
