RE: The tariff classification of two scent sprayers from Italy

Dear Ms. Yvort:

In your letter dated March 30, 2011, you requested a tariff classification ruling regarding two glass bottles with scent sprayers. Two representative samples, designated in your letter as Sample A and Sample B were submitted with your ruling request.

Sample A, described in your letter as 50 ml Klee bottle 18/415, is a square-shaped clear glass bottle measuring approximately five and one-half inches in height by one inch in width. The bottle has a one inch threaded neck and a one-quarter inch opening. The bottle includes a thin plastic tube attached to a plastic finger actuated scent sprayer. A removable plastic cap is included.

Sample B, described in your letter as 50 ml Klee bottle 18/415, is a square-shaped clear glass bottle measuring five and one-half inches in height by one inch in width. The bottle has a one inch threaded neck and a one-quarter inch opening. The bottle includes a thicker plastic tube attached to a plastic finger actuated scent sprayer.

You stated in your letter that each bottle is designed to spray and disperse cosmetic oil.

The applicable subheading for two square bottles with scent sprayer (Sample A and Sample B) will be 9616.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for scent sprayers and similar toilet sprayers, and mounts and heads therefore. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
