RE: The tariff classification of a butyl rubber based adhesive mastic sealant from Germany.
Dear Ms. Rambo:
In your letter dated March 23, 2010, you requested a tariff classification ruling. You provided a Technical Data Sheet, MSDS sheets and photocopies of the product in collapsible wooden crates.
The product consists of black pressure sensitive butyl rubber based adhesive mastic sealant in sausage form for use in the manufacture of road marking tape. The sausages are imported in collapsible wooden crates stacked five or six high. The wooden crates are considered of a kind normally used for such goods and therefore will be classified together with the imported product.
The applicable subheading for the butyl rubber based adhesive mastic sealant sausages packed in collapsible wooden crates will be subheading 3214.10.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Glaziers’ putty, grafting putty, resin cements, caulking compounds and other mastics: Mastics: Other. The rate of duty will be 3.7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
