RE: The tariff classification of a Fitness Band from Taiwan
Dear Ms. Pendris:
In your letter dated March 4, 2011, you requested a tariff classification ruling.
A sample and a photograph of the Fitness Band, item number 69560, were received with your inquiry. The product is an exercise device that consists of a latex band that has a PVC/ABS handle on each end. The fitness band measures approximately 28¾” long x 6½” wide overall including the handle grips. The band is designed for resistance training during an exercise workout. The sample will be returned as requested.
The applicable subheading for the Fitness Band will be 9506.91.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Articles and equipment for general physical exercise, gymnastics, athletics, other sports…or outdoor games…; parts and accessories thereof: Other: Articles and equipment for general physical exercise, gymnastics or athletics; parts and accessories thereof...Other." The rate of duty will be 4.6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
