RE: The tariff classification of Tramadol Hydrochloride Tablets and Tramadol Hydrochloride and Acetaminophen Tablets in dosage form, from India
Dear Mr. Shah:
In your letter dated December 20, 2010, you requested a tariff classification ruling.
The first product, Tramadol Hydrochloride tablets in 50 mg dosage form, is a medicinal preparation containing Tramadol, a centrally acting analgesic, as the active ingredient. It is indicated for the management of moderate to moderately severe pain in adults.
The second product, Tramadol Hydrochloride and Acetaminophen tablets in 37.5 mg/325 mg dosage form, is a medicinal preparation containing Tramadol Hydrochloride and Acetaminophen, as the active ingredients. The combination of these two drugs is indicated for the short term relief of moderately severe acute pain in adults.
The applicable subheading for the Tramadol Hydrochloride Tablets in 50 mg and Tramadol Hydrochloride and Acetaminophen Tablets in 37.5mg/325 mg will be 3004.90.9128, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Analgesics, antipyretics and nonhormonal anti-inflammatory agents: Other.” The rate of duty will be free.
