RE: The tariff classification of filters from China
Dear Crago-Edwards:
In your letter dated August 4, 2010, you requested a tariff classification ruling. A sample of the filter, item number A015OA00418, was submitted with your ruling request and will be returned.
You are requesting a ruling for two filters, which are identified as Laptop Privacy Filters. The filters are composed of black polyethylene terephthalate (PET). Item number A015OA00417 is a filter that is designed to fit a regular laptop screen and it measures 28.6 centimeters from left to right and 21.5 centimeters from top to bottom. Item number A015OA00418 is a filter that is designed to fit a laptop with a widescreen and it measures 30.4 centimeters from left to right and 19 centimeters from top to bottom. Each filter is imported with six tabs which are required for installation. To install the filter, the user needs to separate the tabs, peel the back liner from each, place the tabs on the laptop and slide the filter behind the tabs. The matte side should be facing the user. The filters are advertised as privacy screen protectors which use light control technology to narrow down the visual angle. The light control layer works as a louver. This feature makes those directly in front of the screen see data clearly, while others from a side view see only darkness. Each filter with six tabs and an instruction sheet are packaged in a cardboard envelope ready for retail sale. The filters are not in a mounting.
The applicable subheading for the filters will be 9001.90.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other optical elements, of any material, unmounted, other than optical elements of glass not optically worked. The rate of duty will be 2.9 percent.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
