RE: The tariff classification of a power module and a lamp module from Mexico

Dear Ms. Drenning:

In your letter dated April 26, 2010 you requested a tariff classification ruling.

The merchandise subject to this ruling is a power module and lamp module. The power module and the lamp module are subassemblies of a 9100 Series HID light fixture.

The power module consists of a ballast and electrical cables. The ballast is encapsulated in a resin pod to eliminate all water entry.

From the information you provided, the lamp module is a cylindrical metal housing measuring approximately 18 inches tall with a diameter of approximately 12 inches. It consists of several metal parts with a lamp-holder, lens and gasket. This fixture is designed as a flush mounted up-light for use in planting areas or in concrete for illuminating building facades, walls, trees, and similar applications.

The applicable subheading for the power module will be 8504.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Ballasts for discharge lamps or tubes.” The general rate of duty will be 3.0 percent ad valorem.

The applicable subheading for the 9100 Series HID light fixture lamp module will be 9405.40.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings…: Other electric lamps and lighting fittings: Of base metal: Other.” The general rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
