RE: The tariff classification of Palonosetron Hydrochloride (CAS-135729-62-3) and Carvedilol Phosphate (CAS-610309-89-2), in bulk form, from India and Italy respectively

Dear Ms. Forstenzer:

In your letter dated April 6, 2010, you requested a tariff classification ruling.

The first product, Palonosetron Hydrochloride, is a 5-HT3 antagonist used in the prevention and treatment of chemotherapy-induced nausea and vomiting (CINV).

The second product, Carvedilol Phosphate, is a ß-adrenergic blocker used in the treatment of congestive heart failure and hypertension.

The applicable subheading for the Palonosetron Hydrochloride in bulk form will be 2933.79.0800, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lactams: Other lactams: Aromatic or modified aromatic: Other: Products described in additional U.S. note 3 to section VI.” Pursuant to General Note 13, HTS, the rate of duty will be free.

The applicable subheading for the Carvedilol Phosphate in bulk form will be 2933.99.5300, HTSUS, which provides for “Heterocyclic compounds with nitrogen hetero-atom(s) only: Other: Other: Aromatic or modified aromatic: Other: Drugs: Cardiovascular drugs: Other.” Pursuant to General Note 13, HTS, the rate of duty will be free.
