RE: The tariff classification of a men’s jacket from China
Dear Mr. Mims:
In your letter dated February 12, 2010, you requested a tariff classification ruling. The submitted sample is being returned as requested.
Style number WT320 is a men’s jacket. It is constructed with an outer shell composed of a 100% polyurethane face with a 100% polyester knit backing and a 100% polyester fleece lining. The garment features a full front zipper that extends to the top of the collar, long sleeves with partially elasticized fleece lined cuffs with tabbed hook and loop closures, and a patch pocket on the upper left sleeve with a snap lock closure. The front of the garment features piping across the chest which extends to the sleeve cuffs, a slash pocket and zippered pocket on each side of the garment at the waist and two underarm vent holes on each side. The collar of the garment opens with three hook and loop strips to reveal a hood with elasticized drawstring cord locks. The inner right panel of the jacket contains a zippered chest pocket and the inner left panel contains a cell phone pocket with a hook and loop closure. The inner waistband contains an elasticized drawstring with a cord lock.
The applicable subheading for style number WT320 will be 6113.00.1005, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: having an outer surface impregnated, coated, covered, or laminated with rubber or plastics material which completely obscures the underlying fabric, coats and jackets: men’s or boys’. The rate of duty will be 3.8%.
