RE: The tariff classification of a conveyor system from the US.
Dear Mr. King:
In your letter dated January 18, 2010, you requested a tariff classification ruling. A description and diagrams were submitted with your request.
The item is identified as an MS3000 conveyor, is assembled in and a product of the US and is being considered as separately imported from the other machines that make up a cheese processing system. The purpose of the MS3000 is to transfer cheese from one area to another. The essential components of the machine are flat conveyor belts and a metering belt which is installed on an incline and raises quantities of the cheese so they may be deposited into another machine.
The applicable subheading for the MS3000 conveyor will be 8428.33.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other lifting, handling…machinery: other continuous-action…conveyors, for goods or materials: other, belt type. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
