RE: The tariff classification of an automotive cargo carrier and cargo bag from China

Dear Ms. Jerome:

In your letter dated December 16, 2009, you requested a tariff classification ruling.

The items under consideration are a metal cargo carrier that mounts onto the rear of an automobile and a polyester cargo bag. The cargo carrier is made of corrosion resistant powder coated steel. The polyester cargo bag is designed to be attached via polyester webbing straps. You state that although the two articles will be packaged together they can both be used separately, as an example you give attaching the bag to an automotive roof rack using the web straps.

The applicable subheading for the cargo carrier will be 8708.99.8180, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts and accessories of … motor vehicles … : Other…accessories: Other: Other: Other: Other: Other: Other.”. The duty rate will be 2.5%.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

Your inquiry does not provide enough information for us to give a classification ruling on the cargo bag. Your request for a classification ruling should include a sample of the bag as well as an analysis of the fiber content of the bag. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
