RE: The tariff classification of a combine harvester, populated circuit board from China.

Dear Mr. Draper:

In your letter dated December 3, 2009 you requested a tariff classification ruling on behalf of your client, C2X Solutions, LLC. Information and photos were submitted.

The article is a populated printed circuit board specifically designed and made for installation on a John Deere combine harvester. The board is populated with two interfacing connectors, 14 LED’s, 14 resistors and 6 clinch studs. The board is shaped for installation in an armrest control unit of the combine harvester.

The applicable subheading for the combine harvester, populated circuit board will be 8433.90.5040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for harvesting or threshing machinery,…parts thereof: parts: other, of…harvesting machines and threshing machines: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
