RE: The tariff classification of an ISS Processor and an INR Receiver from Canada.

Dear Mr. Adams:

In your letter dated November 17, 2009, you requested a tariff classification ruling.

The merchandise subject to this ruling request is an Integrated Surveillance System (ISS) Processor and an Integrated Navigation Radio (INR) Receiver, which will be installed into a Boeing 787 Dreamliner aircraft.

The ISS Processor Unit, P/N 822-2120-101, integrates the Traffic Collision Avoidance System (TCAS), the Transponder (TPR), the Terrain Avoidance and Warning System (TAWS) and the weather radar into one unit. Based on the information supplied, the ISS Processor receives sensor inputs from the following: the transponder/TCAS antennas; the radio altimeters; the earth reference units; the air data reference functions (ADRFs); the Integrated Navigation Radios (INRs); and the weather radar antenna via the weather radar receiver/transmitters (R/Ts). In addition, it receives aircraft configuration signals and air/ground signals from various sources. The main function of this ISS Processor is for radio navigational aid.

The INR Receiver, P/N 940-2001-001, integrates the Instrument Landing System (ILS), the GNSS Landing System (GLS), the Global Navigation Satellite System (GNSS) and the VHF Ominidirectional Range (VOR)/Marker Beacon receiver functionalities. The INR is a component of radio navigational aid apparatus for the aircraft.

The applicable subheading for the ISS Processor and the INR Receiver will be 8526.91.00, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Radar apparatus, radio navigational aid apparatus and radio remote control apparatus: Other: Radio navigational aid apparatus. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
