RE: The tariff classification of an LCD monitor with accessories from China.
Dear Mr. Schmidt:
In your letter dated October 16, 2009, on behalf of Roadmaster USA Corporation, you requested a tariff classification ruling. Sample is being returned as requested.
The submitted sample is an LCD monitor, which is referred to as the “Plug n’Play Mobile Video Gaming Solution,” model number VGC100. This monitor, which has an 8.9-inch LCD color screen with built-in range speakers, is designed for vehicular installation. This device, with button controls located on its front panel, is stated to be multimedia ready for playing movies and music and displaying photos, which are recorded onto SD/MMC cards and USB memory sticks; it also enables one to read e-books and text messages, as well as play various game machines.
At the time of importation, the monitor is retail packed with a power inverter, a 12-volt adapter, a headrest mounting bracket, a monitor mounting bracket, an eighteen-foot power cable, a six-foot ground cable, a remote control, and an installation/user guide. This merchandise is considered to be a set for tariff classification purposes, with the essential character being imparted by the LCD monitor.
The applicable subheading for this LCD monitor with accessories will be 8528.59.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatus; reception apparatus for television, whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus: Other monitors: Other: Color: With a flat panel screen: Incorporating video recording or reproducing apparatus: With a video display diagonal not exceeding 34.29 cm. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
