RE: The tariff classification of a plastic garment storage box from China
Dear Mr. Hall:
In your undated letter, which was received in this office on September 9, 2009, on behalf of E-Z DO Inc., you requested a tariff classification ruling.
The submitted sample is identified in your letter as a Garment Storage Bag, Style# MS10-016-200-02. The submitted descriptive literature identifies this item as an under bed box. It is a rectangular shaped box that is constructed of white translucent polypropylene (PP) plastic material. Each side of the box is trimmed around all four edges with strips made of PP fiber material and the sides are all sewn together to form the box.
The back side of the box is made of white knitted fabric, so that the box can collapse into a flat position when not in use. On the inside of the box, located at the knitted side, there is a flap made of the same PP plastic material as the other sides of the box, and it measures the same size dimensions as the knitted side. When the flap is flush against the knitted side, that side becomes more rigid like the other sides of the box, so that it cannot collapse into a flat position.
The front side is a flap that can open and close to gain access to the box. The front flap has an aperture that is reinforced with a metal grommet and serves the role of a handle by which the box can be pulled out from under a bed. There is a hook and loop fastener located on the inside edge of the front flap and the inside edge of the adjacent side. The box measures approximately 23” x 16” x 6”.
The applicable subheading for Style# MS10-016-200-02 will be 3924.90.5600, Harmonized Tariff Schedule of the United States (HTSUS), which provides for…other household articles…of plastics: other: other. The rate of duty will be 3.4 percent ad valorem.
