RE: The tariff classification of a plastic fork, spoon and knife from China
Dear Mr. Musser:
In your letter dated August 7, 2009, on behalf of Import Food Network LLC, you requested a tariff classification ruling.
The submitted samples are identified as Biodegradable Cutlery (Fork, Spoon & Knife). These items are all made of 100% Plastarch material (PSM), which is a biodegradable polymer that is derived primarily from modified corn starch that is mixed with much lesser amounts of cellulose and enzymes. All three samples are white in color.
The applicable subheading for the Biodegradable Cutlery (Fork, Spoon, Knife) will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tableware, kitchenware…of plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
