RE: The tariff classification of an alarm clock from China
Dear Ms. Jewett:
In your letter dated August 4, 2009, you requested a tariff classification ruling. A sample of the alarm clock was submitted with your letter and is being returned as requested.
The submitted sample, item number ST-C2004, is a battery powered quartz analog table alarm clock. The face of the clock features Arabic numbers 1 through 12. The clock requires one AG13 button cell type battery. The clock measures approximately 2 inches in diameter and is housed in a black plastic case. The case measures approximately 3 inches high by 3 inches wide.
The applicable subheading for the alarm clock, item number ST-C2004, will be 9105.11.80, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other clocks; alarm clocks; electrically operated; other. The rate of duty will be 30 cents each plus 6.9 percent ad valorem on the case plus 5.3 percent ad valorem on the battery.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
