RE: The tariff classification of PM200 (CAS-26099-09-2) Polymaleic acid resin from Canada.

Dear Mucciarone:

In your letter dated July 8, 2009, on behalf of Lexikem Canada Inc., you requested a tariff classification ruling. You provided a Certificate of Analysis for our review.

PM 200 is a liquid Polymaleic acid resin consisting of a 30-60% concentration of maleic acid polymer in aqueous solution. The product will be imported in 245 kilogram polydrums for use as a dispersant and scale inhibitor in industrial water treatment, cooling water treatment and all types of water based formulations. The applicable subheading for PM 200 Polymaleic acid resin will be 3911.90.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Petroleum resins, coumarone-indene resins, polyterpenes, polysulfides, polysulfones and other products specified in Note 3 to this chapter, not elsewhere specified and included, in primary forms: Other: Other: Containing monomer units which are aromatic or modified, or which are obtained, derived or manufactures in whole or in part therefrom: Thermosetting: Other. The rate of duty will be 5.8%, ad valorem.
