RE: The tariff classification of Clear Water Tablets from India

Dear Ms. Young:

In your letter dated August 3, 2009, you requested a tariff classification ruling.

The subject product, Clean Water Tablets, consists of the active ingredient Sodium Dichloroisocyanurate acid (NADCC). Sodium Dichloroisocyanurate is a stable source of chlorine used as a disinfectant, biocide, industrial deodorant and detergent. Your letter states, NADCC is a bactericidal and algaecide agent used to disinfect and sterilize water. It works by decreasing the buildup of algae. This product is available in an effervescent tablet and once it is placed into the water, it produces hypochlorous acid. Per your letter, this product is considered to be an organic chloramine, which can liberate up to 63% of available chlorine and will be imported in tablet form.

The applicable subheading for the Clean Water Tablets will be 3808.99.9500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insecticides, rodenticides, fungicides, herbicides, antisprouting products and plant-growth regulators, disinfectants and similar products, put up in forms or packings for retail sale or as preparations or articles (for example, sulfur-treated bands, wicks and candles, and flypapers): Other: Other: Other: Other: Other.” The rate of duty will be 5% ad valorem.

The merchandise in question may be subject to antidumping duties or countervailing duties.
