RE: The tariff classification of a sequined, knit, looped pile fabric from Korea
Dear Ms. Reeder:
In your letter dated July 20, 2009, on behalf of Hobby Lobby Stores, Inc., you requested a tariff classification ruling. Two fabric samples were submitted with your ruling request.
The first submitted sample is identified as Item 114199. It is a knit, looped pile fabric composed of 60% nylon and 40% metallic threads. It is characterized by the placement of metallic-look sequins on one side of the fabric, spaced approximately 0.5 centimeters apart. This fabric will be used for home sewing.
The applicable subheading for Item 114199 will be 6001.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pile fabrics, including “long pile” fabrics and terry fabrics, knitted or crocheted, looped pile fabrics, of other textile materials. The duty rate will be 7%.
Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.
Your inquiry does not provide enough information for us to give a classification ruling on Item 701326. Your request for a classification ruling should include a complete description of how the snakeskin pattern is applied to the fabric (Is the plastic applied in the pattern? Is a plastic film applied and then embossed to achieve the pattern? Is some other method used?) What is the construction of the underlying fabric? Is this a pile fabric (created by a separate yarn which forms the pile), or is this brushed? If this is a pile fabric, specify the type: long pile, looped pile, terry, velour, etc. If pile, has the pile been cut? Please provide a sample at least 18 inches square to include at least one selvage (from selvage to selvage if possible). When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Maribeth Dunajski at (646) 733-3045.
Sincerely,
