RE: The tariff classification of an adjusting screw for an automotive air throttle body from Japan

Dear Mr. Garcia:

In your letter dated July 17, 2009 you requested a tariff classification ruling. Descriptive literature and an illustration were submitted.

The item you plan to import is described as an “adjusting screw,” part number MD614948, for an automotive air throttle body. This screw is made of plastic and resembles a Phillips head screw. It measures 28 mm in length with a thread diameter of 8 mm and has a round Phillips head. The adjusting screw is a component that fits in a pre-threaded hole within the throttle body which is a form of valve used to control the amount of air entering the intake manifold of a vehicle’s engine.

The applicable subheading for the adjusting screw will be 8481.90.9085, HTSUS, which provides for parts of taps, cocks, valves and similar appliances. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
