RE: The tariff classification of a machined cast steel casing made in China

Dear Mr. Mahal:

In your letter dated June 16, 2009, on behalf of Barco, Division of Marison Industries, you requested a tariff classification ruling on a cast steel casing. Samples of the unfinished machined steel casing and the Nitrided steel casing were submitted for our review. Drawings of the steel casing, the machined steel casing, the Nitrided steel casing, the E-75 RS Rotary Union components, and the catalog illustrating the various combinations of components comprising the steel casing and the industry applications of the Rotary Union were provided with your ruling request.

The subject item is identified in your letter as a cast steel casing part for the Barco E-75 RS Rotary Union. The item is described as a machined cast steel casing with two ball bearings assembled within at the time of importation into the United States. You indicate that after importation, the bearings will be taken out to allow the casing to go through a surface hardening treatment process for corrosion prevention. After this process is completed, additional components including the ball bearings and the correct sleeve for the application will be incorporated within the steel casing to complete the part.

You indicate that the cast steel casing is a part for the E-75 RS Rotary Union. The Rotary Union is a device for the conveyance of water or steam between a stationary supply pipe and the rotating machinery application. The Water Rotary Union is primarily used in the printing, paper, rubber, plastics and steel processing industries.

Your samples will be returned as you requested.

The applicable subheading for the machined cast steel casing will be 7326.90.8588, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel, other, other, other, other, other. The rate of duty will be 2.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
