RE: The tariff classification of a motorized trailer mover from China.

Dear Ms. Moore:

In your letter dated July 8, 2009 you requested a tariff classification ruling on behalf of your client Tri-Global Enterprises, Inc. Descriptive information and a photo were included.

The device is said to be a motorized trailer mover. It consists of a single axle with two wheels at the base end of a t-shaped operator’s handle. A ball type trailer hitch is attached to the frame above and centered between the two wheels. Although the photo does not show any form of self-propulsion, the information submitted states that a twelve volt motor will be included to assist in movement. The device is designed to allow the user to haul or push a trailer short distances after connection to the device.

The applicable subheading for the motorized trailer mover will be 8701.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tractors: pedestrian controlled tractors. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
