RE: The tariff classification of a wine bottle bag from China
Dear Mr. Scibelli:
In your letter dated June 23, 2009, you requested a tariff classification ruling on behalf of your client, Tricoastal Design Company. Your sample is being retained by our office.
A style number was not provided for the sample submitted. The item is a non-woven polypropylene wine bottle bag coated on the outer surface with a sheeting of plastic. It is designed to provide storage, protection, portability, and organization to its contents. The bag has a compartment for a single bottle of wine, an open top, and double carrying handles. The carrying bag is of durable construction and capable of repetitive use. It measures approximately 5” (W) x 13” (L) x 3.5” (D).
The applicable subheading for the wine bottle bag will be 4202.92.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for in part, for other bags and containers, with outer surface of sheeting of plastic, other, other, other. The rate of duty will be 17.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
