RE: The tariff classification of collectible cups from China
Dear Ms. Ford:
In your letter dated June 18, 2009, on behalf of A&A Global Industries, Inc., you requested a tariff classification ruling.
The sample submitted with your request is identified as an NFL team cup with frosted logo. The product is a collectible plastic cup with square sides. The cup measures approximately 1 inch square by 1 ½ inches high and is imprinted on the front with an NFL team logo. The cups are available with logos from all 32 teams. Because of their small size and square shape, the cups are not suitable for use as drinking cups. They are intended to be collected and displayed. After importation the cups will be packaged into individual capsules and dispensed from vending machines.
The applicable subheading for the collectible cups will be 3926.40.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics…statuettes and other ornamental articles. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
