RE: The tariff classification of a leno woven fiberglass fabric from China.
Dear Mr. Lupito:
In your letter dated June 5, 2009, on behalf of your client Energex Wall Systems, you requested a tariff classification ruling.
The submitted sample, identified as Fiberglass Mesh, is a white fiberglass leno woven fabric made from glass yarn. White is the natural color of the mesh fabric. This product will be imported in rolls approximately 38 inches in width and 150 feet in length. The weight of the finished product is approximately 145 g/m2. Your correspondence indicates that the principal use of this mesh will be for EIFS (Exterior Insulation and Finishing Systems), soft coat stucco exterior finish coating systems for buildings.
The applicable subheading for this fabric will be 7019.59.4010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glass fibers (including glass wool) and articles thereof (for example, yarn, woven fabrics), other woven fabrics, other, not colored, other, weighing 185 grams or less per square meter. The rate of duty will be 7.3%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
