RE: The tariff classification of cloth baby carriers from China
Dear Ms. Dawson:
In your letter dated May 8, 2009, you requested a tariff classification ruling.
The submitted samples are three (3) Cloth Baby Carriers. The first carrier is described as the
4-Way - Easy-Touch - Color baby carrier. It is constructed of textile fabric, padding, and a plastic rectangular seat platform. It has padded shoulder straps that are adjustable with webbed straps and plastic buckles. It can be worn in front or on the back, with both straps over the shoulders or one around the waist or neck. The baby may face forward or backward.
It includes a drawstring mesh bag so that the folded up carrier can be carried and stored.
The second carrier is called a Recline Position Carrier. It is constructed of textile fabric, padding, and a plastic rectangular seat platform. A padded shoulder strap allows it to be worn over one shoulder to hold the baby in cradle-like position. The baby rests on the flexible padded seat with a flexible headrest.
The third carrier is called a Hip Carrier and is constructed of textile fabric and padding, with an adjustable padded waist strap and webbed adjustment straps. It is strapped around the waist and the baby is carried on one hip. It also features a pouch pocket with a gathered opening on the back of the seat.
The applicable subheading for the baby carriers will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

The samples will be returned as requested.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
