RE: The tariff classification of a strap, brackets and a hook from an unknown country
Dear Mr. Karlsson:
In your letter dated March 26, 2009, you requested a tariff classification ruling. A picture of the products was submitted with the ruling request.
The merchandise under consideration is a strap, brackets and a hook used for mounting and storing hand-held fire extinguishers.
The first item is described as a Metal Bracket. It is a mounting made of steel that functions to hang a charged fire extinguisher from a wall. It includes a metal strap that serves to secure the extinguisher to the mounting.
The second item is described as a Plastic Bracket. It is made of Polypropylene and is designed to mount a charged fire extinguisher to a wall or inside a vehicle.
The third item is described as a Plastic Hose Strap. It is made of Zytel and is designed to encircle the body (cylinder) of a fire extinguisher to hold and secure the extinguisher’s discharge hose during storage.
The last item is described as a Wall Hook. It is made of steel and functions to mount a charged fire extinguisher to a wall.
The applicable subheading for the steel bracket and steel wall hook will be 8302.50.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for base metal mountings, fittings and similar articles…hat-racks, hat pegs, brackets and similar fixtures, and parts thereof. The rate of duty will be free.
The applicable subheading for the plastic bracket will be 3925.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for builders’ ware of plastics, not elsewhere specified or included, other. The general rate of duty will be 5.3 percent ad valorem.
The applicable subheading for the plastic hose strap will be 3926.90.9980, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other. The general rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
