RE: The tariff classification of a shaft, sleeve and stud for liquid pumps from Korea
Dear Ms. Evans:
In your letter dated March 3, 2009, on behalf of Summit Pump, Inc., you requested a tariff classification ruling. Descriptive literature and illustrations were submitted.
The articles in question are described as a shaft (item number 122), a sleeve (item number 126) and a stud/gland (item number 353). They are all made of stainless steel and are designed for use in liquid pumps, model numbers 2196 and 2175. You suggest that all three items are correctly classified under 8413.91.9080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other parts of pumps.
With regard to the shaft, examination of the submitted literature reveals the pump shaft features a machined “flat” or keyway that would presumably facilitate the transmission of torque. As such, we find that the pump shaft is specifically provided for as a transmission shaft in HTSUS heading 8483.
The notes to Section XVI of the HTSUS govern the classification of articles under HTSUS headings 8413 and 8483. Section XVI, Note 2(a), provides that parts, which are goods included in any of the headings of chapter 84 of the HTSUS are in all cases to be classified in their respective headings.
Heading 8413 and heading 8483 are in chapter 84 of the HTSUS. In accordance with Note 2(a) to HTSUS section XVI, since the shaft is an article of heading 8483, HTSUS, whether or not it is a part provided for in HTSUS heading 8413, the shaft must be classified in HTSUS heading 8483.
The applicable subheading for the pump shaft will be 8483.10.5000, HTSUS, which provides for other transmission shafts. The rate of duty is free.

Your inquiry does not provide enough information for us to give a classification ruling on the sleeve and the stud/gland. Does the sleeve support a rotating shaft and function like a sliding bearing? Please provide samples of the studs/glands (item number 353) that will be used in model numbers 2196 and 2175. In addition, describe in detail how the stud functions?
