Dear Mr. Wildstein:
In your letter dated February 26, 2009, you requested a tariff classification ruling for Hydroxy ethylene diphosphonic acid, also known as Etidronic acid, which you have stated will be used in water treatment.
The applicable subheading will be 2931.00.9043, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other organo-inorganic compounds: Other: Other: Organo-phosphorus compounds: Other. Pursuant to General Note 13 to the Harmonized Tariff Schedule, this product will be free of duty.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
